Aurinia said it and its U.S. subsidiary entered into a settlement agreement with Teva Pharmaceuticals to resolve patent infringement litigation connected to Teva’s Abbreviated New Drug Application to market generic 7.9 mg voclosporin oral capsules in the U.S.
Under the settlement, Teva stipulated that Aurinia’s U.S. Patent Nos. 10,286,036 and 11,622,991 are enforceable and valid, and that Teva’s commercial sales of its generic voclosporin product in the U.S. would infringe those patents.
The agreement also sets a timing framework: Teva may launch its generic voclosporin product no earlier than December 7, 2036, unless certain defined contingencies occur earlier. Teva’s ability to market the generic in the U.S. is also contingent on FDA approval.
Aurinia added that its related patent infringement actions continue against other companies in the U.S. District Court for the District of New Jersey.
