Capricor Therapeutics ($CAPR) was in focus on Jul 30, 2026 after a securities lawsuit notice highlighted FDA criticism of its data-analysis approach ahead of an advisory committee review, and the stock rose 36.5%.

What Capricor announced

A securities-law firm notice flagged a proposed class action tied to Capricor, naming a class period from December 17, 2025 through July 26, 2026. The notice points to FDA briefing documents released ahead of a July 29 advisory committee meeting for the company’s BLA.

According to the FDA’s briefing materials cited in the notice, Capricor made changes to its pre-specified statistical analysis plan (SAP), and the final version “was not submitted to FDA for review prior to BLA submission and was not discussed and consequently not agreed upon.” The FDA also said the final SAP was created one day before the data was unblinded. The agency disagreed with the changes, stating it did not consider the conversion approach described to be scientifically justified and said it “adds complexity and reduces accuracy.” As a result, the FDA said it considers analyses based on the post-study SAP versions to be “post-hoc and exploratory.”

What it means for Capricor

The notice puts fresh attention on a core regulatory issue: whether the FDA views the company’s analyses as pre-planned and reliable, or as after-the-fact and exploratory. If regulators are skeptical of the analysis framework used to support a BLA, that can raise questions about how persuasive the submission will be in an advisory committee setting.

It also underscores legal risk. A class action centered on how information was presented around the BLA process can keep pressure on management communications and increase scrutiny of process decisions, especially around timing and documentation.

At the same time, the market’s response suggests traders were actively repricing the situation on the day, even with the legal headline in the mix.
